By-laws
In accordance with the Cities and Towns Act  (L.R.Q. c. C-19) and the Municipal Powers Act (L.R.Q. c. C-47.1), the legislature has conferred certain powers on municipalities.

You will find herewith a summary explaining some of the by-laws in force at the Town of Stanstead. Please take note that full versions of these by-laws can be found in the by-laws book,  and is available for consultation,  at the Town of Stanstead during business hours.

Permits and certificates

By-law 2001-22 concerning permits and certificates

• Subdivision Building Permit
• Construction permit
• Certificate of partial occupancy
• Certificates of Approval for various purposes

Painting and minor repairs are not considered repairs for the purposes of this By-law. Minor repair means a repair requiring an expenditure of less than 2 000$ which can normally be done by an owner within a period of 48 hours without having to use the services of a contractor or a skilled worker and that does not imply work under the Canadian Electrical code or the Quebec plumbing code .

By-law 99-111,  title IV, chapter I, concerning permit to operate a place of business

A permit for commercial occupancy is necessary in order to operate any business, new or existing, within municipal boundaries. Said permit is valid for three years, ending on April 30th of the third year. The cost of the permit is 50.00$. Please feel free to address the town inspector, Mr. Stanislav Korolev, for more detailed information on this subject.

Residual and recyclable materials

By-law  2007-93 concerning management of solid wastes, recyclable materials and bulky waste  

• Household waste must be placed in plastic bags and inside a  waterproof container with a lid or inside a roll-out bin of 360 litres.
• Leaves are picked-up only at special pick-up times.
• Non metallic bulky waste is picked up on days for household waste and  metallic bulky waste is picked up on days for recyclable materials.
• It is forbidden to place household waste in 360-litre blue recycling bins. Please refer to the list of accepted recyclable materials here.
• Recyclable materials must be placed in 360-litre blue recycling bins.
• Bins and containers must be taken out, at the earliest, the night before the pick up at 7:00 P.M. and taken back in, at the latest, at 9:00 PM on the day of the pick-up.
• Hazardous household materials and construction/demolition materials must be taken to the eco-centre.
• Any physical person who contravenes this by-law may be fined a minimum of $100 and a maximum of $1,000, and up to $2,000 for a subsequent offence. Any moral person who contravenes this by-law may be fined a minimum of $2,000 for the first offence and $4,000 for a subsequent offence.

Fire and burnings

By-law 2009-112 concerning outdoor fires and burning of various materials

• It is prohibited to have an open air fire without previously obtaining a permit to do so, said permit being freely available at Town Hall. An exception to this rule is made for citizens making a fire in an outdoor fireplace sold for this purpose.
• Any fire must remain a recreational fire : the activity takes place for recreational purposes only. All wood materials, scrap and parts of wooden constructions must be recycled if they are new or brought to the eco-center if they contain nails or paint.
• A permit may not be requested more than 72 hours in advance and is valid until the end of the current year, renewable only the next year.
• The signature of the owner of the premises where the fire will be required is required on the permit application form. The tenants of the premises can also sign for the permit, upon the owner's written authorization.
• It is the permit applicant's responsibility to check with the Protection Forest Society to make sure that the inflammable index indicates moderate or under moderate conditions before lighting the fire.
• It is forbidden to use polluting materials as fuels, such as: any type of plastic, tires or other rubber materials, any construction/demolition waste, hydrocarbons, refuse, varnished or painted wood, etc.
• Any physical person who contravenes this by-law is liable to a minimum fine of $200 and a maximum  fine of $1,000 up to $2,000 in the case of a subsequent offence. A moral person who    contravenes this by-law is liable to a   minimum fine of $4,000 for the first offence and $8,000 for a subsequent offence.
• It is the responsibility of the person lighting the fire check with SOPFEU the flammability index is at moderate or below moderate before lighting the fire.
• It is forbidden to use pollutants - such as plastics, tires, waste from construction / demolition, hydrocarbons, trash, painted or varnished wood, etc.- as fuel.
• Any individual in violation of any provision of the By-law is liable to a minimum fine of $ 200 and up to $ 1 000, fines for subsequent offenses being up to $ 2 000 for each. Any moral person in violation of any provision of the By-law is liable to a fine of $ 4 000 for a first offense and $ 8 000 for repeat offenses.

Animals

• No person shall keep more than four animals (4), cats and dogs alike.
• The custodian of an animal living outside must provide a shelter to protect the animal from weather and sun.
• The custodian of an animal may not abandon it; the person must either find a new home for the animal, bring it to the SPA or have it euthanized.
• The custodian must immediately clean up the animal's feces.
• Mistreatment or willfully injuring an animal is prohibited.
• Any owner of cat or dog must obtain a license for it from the SPA de l'Estrie.
• It is forbidden to leave a dog at large beyond the boundaries of its custodian's  land. The dog must be leashed.

Watering and water consumption

•  The period for watering lawns, gardens, flowers and bushes is from May 1st to September 1st between 7:00 p.m. and midnight and between 5:00 a.m. and 10:00 a.m. on the following days:
•  For occupants of buildings with even numbers: Wednesdays and Saturdays.
•  For occupants of buildings with uneven numbers: Tuesdays and Sundays.
However, there is an exception for new lawns (see the Building Inspector for more information).  
•  Pools may be filled every day of the week between 7:00 p.m. and 6:00 a.m.
•  In case of a shortage notice issued by the town, no watering will be allowed during the specified period.
